Terms & Conditions

The following Terms and Conditions apply to all bookings made on this website. We cordially ask that you take a moment to read them prior to making a Booking.

The Company enters into this Agreement as principal for Bookings made for Sun Gardens Dubrovnik. 

In these Terms and Conditions the following definitions apply:

1. DEFINITIONS

“Company” or “we” means Dubrovački Vrtovi Sunca d.o.o., with registered offices in Croatia, Orašac 20235, Na moru 1. 
“Booking” means a booking for accommodation, functions and/or any other services or items made with us.
“Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.
“Resort” means the Sun Gardens Dubrovnik rooms, suites and/or residences for which your Booking is made. 
“Terms” means these terms and conditions.
“Websites” means www.sungardensdubrovnik.com, www.dubrovniksungardens.com or any other website owned or operated by us relating to a Resort.
“VAT” means value-added tax.

2. BOOKINGS

All Bookings at the Resort are subject to these Terms.
At the time of booking or at check-in, your credit/debit card details will be taken and you authorise the use of this card for any sums that are owed to us. We shall also have the right to require full payment in advance or a deposit at the time of booking if the Booking is made with these conditions. No Booking shall be treated as confirmed until the details and/or payment/deposit described in this paragraph have been provided.

GROUP BOOKINGS

Five (5) rooms or more with the same arrival and departure date is considered a group and must be booked directly with the company group reservations team. For group inquiries, please e-mail us at [email protected]. The group booking terms and conditions can only be offered by the company directly. The Company reserves the right to cancel group bookings made through booking channels other than the company group reservations team. 
In the e-mail proposal from the Company, all details about the group booking, rates and conditions are specified.

3. ROOM RATES

The prices displayed on the Websites are an average per night per room until a rate is selected. VAT is included in the rate. Any additional services are included only if specified. A minimum length of stay, deposit, cancellation charge and other conditions may apply to certain rates, as specified on the Website. Once a rate is selected on the Website, the total for your requested stay shall be displayed on the reservation summary.
If the request for booking is made by e-mail, all the above-mentioned details (length of stay, rates, deposit, cancellation charge and other conditions) should be specified in that e-mail (offer). 

The payment is done in EUR currency. When charging your credit card, the amount is converted into your local currency according to the exchange rate of the credit card associations. As a result of this conversion, there is the possibility of a slight difference from the original price stated on our Website. 

The city tax* is not included in the rate and it amounts to 1,86 € (14 Kn) per person per day from January 1 to March 31, 2023 and October 1 to December 31, 2023, and 2,65 € (20 Kn) per person per day from April 1 to September 30, 2023. However, the city tax is visible and clearly stated upon conducting the online reservation (and stated in the e-mail) as part of the final price, but shall not be charged in advance and needs to be paid directly at the reception. Children from 12 to 18 years old have a 50% discount on City tax. Children up to 2 years old do not pay city tax. The fixed EUR exchange rate is 1 € = 7,53450 Kn. *The city tax may be subject to change by local authorities without prior notice.

4. CHECK-IN / CHECK-OUT REQUIREMENTS

At the time of check-in, guests are required to confirm their identity by providing their booking reference, their passport/identity card and a valid credit or debit card that will be used as a guarantee for payment. The Company is also obliged by law to record the number of the passport/identity card, the guest’s date and place of birth and nationality.

The information above will be requested for each guest and the Company reserves the right to refuse entry to persons who cannot provide the information set out above.

Check-in time for hotel rooms and suites is 2 pm on the day of arrival, and 4 pm on the day of arrival for Residences. All rooms that have been secured by credit/debit card or prepaid at the time of booking will be held until 11:59 pm on the scheduled day of arrival unless otherwise agreed directly with the Company. 
Departure time (check-out) for all accommodation units (hotel rooms, suites and residences) is 11 am. Late check-out after this time can be requested and it is subject to availability and additional fees.

Accommodation units are subject to the maximum occupancy rules set by the Company, as follows:
• Maximum capacity for Standard, Deluxe and Club rooms is 2 persons
• Maximum capacity of the Deluxe Suite and Club Suite is 3 persons (the third person is accommodated on a single extra bed in the living room and extra charges apply.
• Maximum capacity for 1 bedroom residences is 3 persons (the third person is accommodated on a pull-out sofa bed in the living room)
• Maximum capacity for 2 bedroom residences is 5 persons (the fifth person is accommodated on a pull-out sofa bed in the living room)
• Maximum capacity for 3 bedroom residences is 7 persons (the seventh person is accommodated on a pull-out sofa bed in the living room)
• Maximum capacity for an in-resort villa with a private pool is 10 persons

Baby cot (maximum 2 per room) can be provided complimentary for a child up to 2 years old upon request.

5. PAYMENT

We accept the following methods of payment: cash, credit cards: American Express, MasterCard/Diners International, Diners Club, JCB International Credit Card, Visa; debit cards - Visa/Delta and Visa/Electron. For advance purchase rates, the card you booked with must be presented on arrival, along with the appropriate ID. All outstanding charges must be paid in full on check-out at the latest.

6. CANCELLATION POLICY AND NO SHOWS

The cancellation policy varies according to the rate that is booked. Please refer to the individual full rate descriptions given at the time of booking.

The rates marked as "Best Available Rate" can be cancelled without charge up to 5 days before the arrival date. After this time, 100% of the total stay is charged, even in case of no-show or early departure. Cancellation and no-show charges apply after the relevant time and are charged to the credit/debit card provided at the time of booking.

For rates marked “Advance Purchase”, the Company requires full prepayment in EUR for the entire stay at the time of the Booking and this is non-refundable, and no modifications of the Booking are allowed. Cancellation or non-arrival will result in the forfeiture of the prepayment.

7. CHANGES OR CANCELLATIONS BY THE COMPANY

If the Company needs to cancel a guest's Booking, the guest will be given a full refund and the Company shall have no further liability to the guest arising from such cancellation. The Company will, however, use reasonable endeavours to try and relocate any confirmed Booking that is cancelled to an alternative location similar in standard to the Company.
The Company reserves the right to allocate guests in any room within the reserved room class. Allocation to a specific accommodation unit cannot be guaranteed prior to check-in.

If you have indicated a preference for a particular room during booking, the Company holds the right to move you to a different room type for operational reasons.

8. DAMAGE

The Company reserves the right and you hereby authorise the Company to charge your credit or debit card for any damages incurred to your room or to the Company property during your stay (including without limitation special cleaning) or for any items that are missing from your room when you leave.

9. SPECIAL REQUIREMENTS AND DISABILITIES

We welcome guests with limited mobility, a disability and medical or particular care requirements. We aim to ensure that our services are as accessible as reasonably possible so it is important that you make us fully aware of any special needs, requirements and conditions. A risk assessment may also be required prior to confirming a Booking or participation in certain leisure activities. We rely on the information you provide to help us anticipate and satisfy your needs. You must therefore update us with any changes in circumstances prior to and during your stay.

10. VISA

It is your responsibility to obtain a visa for entry into Croatia. No refund will be granted in case entry to Croatia is refused/denied. The Company shall not be responsible for any extra charges arising due to entry or exit visa fees. The same rule applies for all medical vaccination costs necessary to enter any Country. You are also responsible for obtaining all transportation tickets necessary. No refund will be granted in case of delayed arrival at the Resort (a day or more).

11. THE SECURITY OF ONLINE PAYMENTS

Sun Gardens Dubrovnik uses WSPay for online payments.

WSPay is a secure system for online payments, real-time credit and debit card payments, and other payment methods. WSPay ensures the buyer and the merchant with secure card data entry and transfer, which is also confirmed by PCI DSS certificate. WSPay uses 256-bit SSL encryption and TLS 1.2 cryptographic protocol as the highest protection standards for data entry and transfer.
