“SIGN UP & WIN CONTEST” Rules

Before participating in the contest, please read these rules.

Article 1. Organizer

1.1. Organiser of the contest “WIN A HOLIDAY IN 2026” is DUBROVAČKI VRTOVI SUNCA D.O.O. (Address: Na moru 1, 20235 Orašac, Dubrovnik OIB: 40198223665) in the section Organiser.

Article 2. Duration

2.1. The contest starts on May 15, 2025 and ends on October 31, 2025 at 20:00h.

Article 3. Rules

3.1. All entrants into this Contest shall be deemed to have accepted these Terms and Conditions.

3.2. The Organiser reserves the right to change the terms, of which all participants will be timely informed.

Article 4. Eligibility

4.1. All individuals aged 18 and over are eligible to participate in the Contest, provided they follow the official Sun Gardens Dubrovnik Instagram page (https://www.instagram.com/sun_gardens_dubrovnik/), comment on the designated contest post, and tag another individual they would choose to bring.

4.2. Owners, management and employees of the Organizer and their immediate family are not able to participate in the Contest.

Article 5. The participation

5.1. To participate in the Contest, users should:

• Follow the official Instagram page of Sun Gardens Dubrovnik (https://www.instagram.com/sun_gardens_dubrovnik/);
• Leave a comment under the designated contest post; and
• Tag another individual they would choose to bring.

Article 6. Disqualification

6.1. The Organiser reserves the right to disqualify participants at any time during the contest, for the following reasons: Participants who do not comply with these Terms & Conditions, and/or Participants violate these rules or leave inaccurate personal information when giving consent.

Article 7. Award

7.1. The prize will be awarded to one selected contestant.

7.2. The winner will receive the following prize: 4-night stay at Sun Gardens Dubrovnik resort in 2026 (maximum 5 people), bottle of wine, canapees and macarons in room upon arrival, rich buffet breakfast daily, unlimited access to the award-winning Spa Centre and multifunctional Sports Centre.

7.3. The prize is non-exchangeable, non-transferable and not redeemable for cash or any other prize.

7.4.The prize does not include airplane tickets or transfer from the winner’s home to the airport in their country, city tax, travel insurance, food other than specified, drinks, personal expenditure or incidental costs. The Organizer accepts no responsibility for any costs associated with the prize that are not expressly included in the prize.

7.5. The prize must be used from April 01 – June 30, 2026 or September 01 – October 31, 2026, subject to availability until the booking has been confirmed by the Organizer. Once confirmed the booking cannot be amended.

7.6. It is the responsibility of the prize winner to ensure they and their guest(s) have a valid passport and travel insurance and obtain any necessary visas for their trip.

7.7. The winner will be informed about the details, especially the available booking period, and the takeover of their prizes in time.

7.8. The winner will be selected by the rules laid down in sections 4 and 5, assuming that their applications are in accordance with the rules in section 6.

7.9. Application users who participate in this Contest have no right to demand other prizes than those specified in these Rules nor give the reward to someone else, or designate someone else as a winner.

7.10. If any participant selected as the winner is not eligible as the winner according to these Terms & Conditions or is disqualified for any reason, the Organiser reserves the right to determine an alternative winner or not to award that winner’s prize, at the sole discretion of the Organiser.

Article 8. Results of the contest and the taking over of the prizes

8.1. The name of the winner will be published on the official company webpage within three (3) working days of the Contest closing date. The award winner will be notified about the award by e-mail. If the winner fails to respond to the organiser within 7 days of being notified of their win, the winner’s prize will be forfeited and the Organizer will be entitled to select another winner.

8.2. Obtaining the prize will terminate all obligations of the Organiser towards the winner.

8.3. The winner agrees to have his name, in accordance with sections 1. and 2. of this article, revealed.

Article 9. Protection of personal data

9.1. The Organiser of the contest takes special care in regards of the collection and processing of your personal data, which may include your photograph and your name and or/surname or other names visible from your Facebook/Instagram profile. The aforementioned personal data must be submitted in order to participate in this Contest, and by entering into this Contest, you are giving your consent for the Organiser to collect and process the aforementioned personal data. Before doing so, please check our Information regarding the collection and processing of personal data as well as our Privacy policy (https://www.dubrovniksungardens.com/en/misc/privacy-policy). 

9.2. Data Controller, as well as the Instagram page/applications administrator, will handle the data in accordance with standards prescribed by the law on the protection of personal data.

9.3. Submission of data for this Contest is voluntary. If the participant believes that the database was processed in conflict with the protection of his/hers privacy or contrary to the law, one can contact the Organizer or Croatian Personal Data Protection Agency and request an explanation.

9.4. The data controller will not reveal or disclose information to third parties.

9.5. The prize winners expressly agree that the Organiser may use, for public notification of the results of the Contest, their name regarding the takeover of prizes in articles and reports without any compensation.

Article 10. Termination contest

10.1. The Contest may be terminated only in the event of circumstances for which the Organiser is not responsible, or which could not be prevented, eliminated or avoided. In that case, the Organiser frees all possible liabilities incurred towards participants

Article 11. Meta (Instagram and Facebook) disclaimer

11.1. Meta (Instagram and Facebook) is not responsible for, nor do have anything with, the promotion of the contest and ere free from all responsibilities towards each individual participant. Instagram is in no way sponsoring or managing the contest, nor is the contest in any way related to Facebook and/or Instagram.

Article 12. Explanation of the rules

12.1. The main interpreter of these rules is the Organizer.

12.2. The Contest and these Terms and Conditions will be governed by Croatian law and participants in the Contest submit to the exclusive jurisdiction of the Croatian courts.
